Overview
These Terms of Service (“Terms”) govern your use of redsrolls.com (the “Site”) and your purchase of products and services from EGGSCELLENTFOODS LLC dba Reds Rolls (“Reds Rolls,” “we,” “us,” or “our”). By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.

Eligibility
You must be able to form a legally binding contract to use the Site and place orders. By placing an order, you confirm that the information you provide is accurate and that you are authorized to use the payment method you submit.
Use of the Site
You may use the Site for lawful, personal, and non-commercial purposes. You agree not to:
- Use the Site in any way that violates applicable law
- Interfere with or disrupt the Site, its security, or its servers
- Attempt to gain unauthorized access to any part of the Site or our systems
- Copy, scrape, or reproduce Site content except as allowed under “Intellectual property” below
We may suspend or restrict access to the Site at any time, with or without notice.
Orders, pricing, and payment
When you place a pickup order, catering request, or bulk order, you are making an offer to purchase. We may accept or decline any order at our discretion, including where an item is unavailable, where there is an error in pricing or description, or where we suspect fraud.
Prices, menu items, and availability may change without notice. We make reasonable efforts to display accurate pricing and product information, but errors may occur, and we reserve the right to correct them.
Payments on the Site are processed by Clover. By submitting payment, you authorize us and our payment processor to charge the total amount, including applicable taxes and fees, to your selected payment method.
Pickup and catering
Pickup orders are prepared for collection at our location at the time indicated. You are responsible for collecting your order at the scheduled time. Catering and bulk orders may require advance notice, minimum quantities, and deposits as communicated at the time of booking. Any catering terms or event details we provide in writing form part of these Terms for that order.
Returns and refunds
All sales are final. By placing an order, you acknowledge and agree that, due to the perishable nature of our food products, Red’s Rolls does not offer refunds, returns, exchanges, or credits once an order has been placed and accepted, except as expressly set forth in this section.
Notwithstanding the foregoing, Red’s Rolls may, in its sole and absolute discretion, issue a refund, credit, or other accommodation solely in extraordinary circumstances arising from a material failure of performance attributable to Red’s Rolls, including but not limited to: (a) the failure to supply an item that a catering or bulk-order client ordered and paid for, where Red’s Rolls is unable to source or substitute the item within a commercially reasonable time prior to the agreed-upon delivery or pickup window; or (b) the failure of the Red’s Rolls food truck to appear at a booked and confirmed event, where such failure is not caused by a Force Majeure Event or by the client.
For the avoidance of doubt, the following do not entitle the customer to any refund, return, exchange, or credit: changes of mind; incorrect orders placed by the customer; failure to collect a prepared order; subjective dissatisfaction with taste, appearance, or quantity where the product was prepared as described; or any circumstance constituting a Force Majeure Event as defined below.
Any accommodation granted under this section in a particular instance shall not constitute a waiver of these Terms or create any obligation to grant the same or similar accommodation in any other instance. To request consideration under this section, you must contact Red’s Rolls within twenty-four (24) hours of the affected pickup, delivery, or event using the contact details above.
Food allergies and dietary information
Our products are prepared in a kitchen that handles common allergens, including but not limited to wheat, gluten, dairy, eggs, nuts, and soy. We cannot guarantee that any product is free from allergens or from cross-contact. If you have a food allergy or dietary restriction, it is your responsibility to review ingredients and contact us before ordering. You assume all risk associated with consuming our products.
Third-party platforms and links
The Site may link to or allow ordering through third-party platforms such as DoorDash and Uber Eats, and to third-party sites such as our social media pages. Those platforms and sites operate under their own terms and policies, and we are not responsible for their content, products, or practices. Orders placed through a third-party platform are subject to that platform’s terms, including its own cancellation and refund policies.
Intellectual property
The Site and its content, including the Red’s Rolls name, logo, text, graphics, images, and menu descriptions, are owned by or licensed to Red’s Rolls and are protected by intellectual property laws. You may not use, reproduce, or distribute our content without our prior written permission, except for personal, non-commercial viewing of the Site.
Disclaimer of warranties
The Site and our products and services are provided “as is” and “as available” without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. We do not warrant that the Site will be uninterrupted, error-free, or secure.
Limitation of liability
To the fullest extent permitted by law, Red’s Rolls and its owners, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or revenue, arising out of or related to your use of the Site or our products or services. To the fullest extent permitted by law, our total liability for any claim arising out of or related to an order will not exceed the amount you paid for that order.
Indemnification
You agree to indemnify and hold harmless Red’s Rolls and its owners, employees, and agents from any claims, damages, losses, or expenses, including reasonable attorneys’ fees, arising out of your misuse of the Site, your violation of these Terms, or your violation of any law or the rights of a third party.
Force majeure
Reds Rolls will not be liable for any failure or delay in performance caused by events beyond its reasonable control, including but not limited to acts of God, severe weather, fire, equipment or vehicle failure, supply shortages, labor disruptions, utility or network outages, government action, or public health emergencies (each, a “Force Majeure Event”).
Governing law
These Terms are governed by the laws of the State of Illinois, without regard to its conflict-of-laws principles. You agree that any dispute arising out of or relating to these Terms or your use of the Site will be brought exclusively in the state or federal courts located in DuPage County, Illinois, and you consent to the jurisdiction of those courts.
Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the “Effective date” above and post the updated version on this page. Your continued use of the Site or placement of orders after changes take effect constitutes acceptance of the updated Terms.
